Obama’s ‘Sister Souljah Moment’ on the Surveillance Bill

Senator Barack Obama’s announcement that he would support the compromise bill providing court and congressional supervision of the president’s Terrorist Surveillance Program (TSP) and immunity for certain telecom companies that cooperated with it has led to a barrage of criticism from his “netroot” supporters on his campaign Web site and in much of the liberal blogosphere.
But the Senator’s position is not only correct on the merits from a pro-civil liberties and pro-privacy rights perspective. It also provided the Senator an important chance to demonstrate his “Sister Souljah moment.”
The latter phrase is a reference to the time when then-Governor Bill Clinton, in a defining moment early in his presidential campaign in 1991, stood up to the black rap star before a black audience for her anti-white attacks in some of her lyrics. The phrase has since become a metaphor for a Democrat showing the political courage to stand up to his or her liberal-left base, rather than pandering to it.
Senator Obama’s change of position has angered some of his more liberal supporters — but, I submit, only because they don’t appreciate the significant legal restrictions placed on the Administration’s conduct of the TSP by this legislation.
The compromise bill was essentially crafted by leading liberals in the House who see no inconsistency between civil liberties and privacy rights and protecting America from another 9/11 attack.
The compromise bill would provide strict supervision by the special FISA Court of all intelligence agency anti-terrorist surveillance activities, with strict time limits on renewal of court orders. It would require written findings and accountability by the Justice Department and individual warrants and court orders if any U.S. citizen is involved, directly or indirectly, in the surveillance. And importantly, it expands congressional oversight of the program, including the House and Senate Judiciary Committees as well as the Intelligence Committees in both chambers.
Most of the liberal opposition concerns the provision of the legislation that would allow immunity from civil cases filed against the telecom companies that cooperated with the TSP and turned over customer data. Concern about such a precedent is understandable. Ideally it should not be a defense to violating privacy rights that a company uncritically chose to rely on bum advice from government officials. Some telecom companies courageously refused to cooperate because they refused to accept such advice.
But, on balance, the value of effecting immediate strict legal and congressional supervision of the TSP should outweigh concerns about such a precedent — especially since the legislation grants immunity only to those companies that can prove to a court of law that they relied in good faith on governmental advice.
No doubt Senator Obama has felt political pain to be attacked publicly by his most ardent supporters. But the benefit is that he has reminded voters that as president he would be more committed to the “solutions” business than to yield to the pressure to prove his ideological purity to his party’s base. Many of the swing voters who will decide the election — soft Democrats, independents and moderate Republicans — have been waiting to see if Senator Obama can resist such pressure and follow this approach. Now they have a good example that the answer is:
Yes he can.

I am starting to think that John Kerry and Barak Obama are brothers…they can open a circus act together and call themselves the “FLIP FLOP BROTHERS”! It would be interesting to see when there is no gun pointed to his head from our enemies, and he still cannot be consistant in any of his position. If he were placed hostage by the enemy, Barak would fold like a deck of cards!! I am having trouble understanding how such a well read man, such as your self, can maintain any self respect in supporting an ill-experienced joke of a candidate such as Obama? I can only assume that you are providing lip service to your democratic constituents… Because no serious individual with credentials such as yours would support such a inept candidate (he is nothing more than a mear speach reader). If he were a Republican with the same resume… he would be laughed out of the race! I hope you take the word of your “former” fellow democrat Joe Lieberman in supporting McCain. On a final note, I would wager that on voting day, even Billy Bob himself will be voting for McCain.

Lanny Davis has nothing better to do these days than to pander to Obama party constituents because his “sister souljah”, Hillary, is no longer in a position to allow him to pander to her. Let’s face it, Obama is a lawyer, is a lawyer, is a lawyer; nothing more. In fact if he had had any common sense or sense of aplomb, he would have graciously declined his party’s overtures to select him as their knight in shining armor. The glaring deficiencies in his character, his past associations and dealings, his accomplishments, his utter lack of knowledge and know-how when it comes to the practical side of leadership in action (not repetitive rhetoric) are embarrassing. But, alas, his loyal constituents, have and now must come to his aid on a daily, if not hourly, basis to salvage his image and reputation. Can it last until November? Who knows. But the longer this campaign continues, the more of this type of convoluted contorting of the facts will likely ensue. Again, the Bush administration is getting kicked in the teeth because it is perceived as overstepping its reach. Let us be mindful of the fact that the U.S. was attacked by terrorists because their activities were not being surveiled. This is not a question of infringement of civil liberties but an act of protection of our country and its citizenry - the first and foremost job of the Commander-in-Chief.
The issue is not whether Obama’s vote was wise or foolish, only that he had repeatedly promised to oppose (even filibuster) any bill that included retroactive immunity. That is not a left-right issue, it is a question of integrity.
I’m going to have to respectfully disagree with your assertion that mainstream America supports the idea of retroactive immunity; mainstream *politicians* support the idea. Don’t get me wrong, people can certainly see the merit of his decision: Its a politically expedient way to change very little while also managing to ruffle as few financial and political feathers as possible, which usually translates into a great campaign move. Plus, why would any potential President purposefully hurt his chances for election by supporting a change in policy that restricts executive reach and leaves his potential White House staff vulnerable to private litigation? People can see the merit in playing it safe, sure. Thats a far cry from respecting the man who lives that way, though.
Fighting this battle, opposing the introduction of retroactive immunity would have been an opportunity to show Americans that he is a politician who cares more for the rule of law than for his personal endeavors.
Most people lack the strength to do that, but then again, this man wants to be President and is therefore subject to the higher standard. Ambition gets the interview, character should get the job.
For the record, I’ve donated time and money to Senator Obama and though I still support his bid, I’d be lying if I said that this wasn’t a pretty severe disappointment.

Call me crazy but basically once they have put a splitter on the “fat pipe” of all phone/voice data, and since everything of course is a “state secret” for matters of “national security,” isn’t all we really have is a promise that the executive will monitor itself? They can listen to all they want, no warrants or real meaningful oversight, and noone would ever know about it. A warrant really only comes to play if they were to bring such a case into the legal system, which clearly they will do everything in their power (and beyond it) to prevent.
But on another note, Kudos to Fox for allowing (GASP) a legitimately fair and balanced article on Obama isntead of the usual pieces which tend to seem otherwise.

Davis is correct in reporting the “how and why” of the Senate’s vote today on the FISA Bill.
The Sister Souljah metaphor probably does describe Obama’s pro vote.
Davis left out the “Therefore” and therein lies the problem.
The “Therefore” pertains to privacy and retribution issues.
No Bill is perfect and certainly the FISA vote today does address the need for congressional overview to protect the rights of innocent Americans.
But how do you better a painting of a purple frog in a green hat? You can paint over the ugly hat, but unless you blot the whole thing out, you still got an ugly frog.

Mr. Davis is a distinguished gentleman and loyal, if you will, to a fault. His loyalty to the Clintons, even in their darkest moments, was remarkable. This genial loyalist defended Hillary Clinton even when one suspected that even she did not believe her sometimes pathetic explanations for words and deeds. Nevertheless, Mr. Davis is entitled to his views and must be congratulated as being the leading cheerleader of all time.
He does have a point that, as Obama rushes in great haste to the political middle, his current statements (which could change at any time) have merit.
I would respectfully point out to Mr. Davis that Obama’s “Sister Souljah Moment” is a bit late. He had golden opportunities to apply that “Moment” to the Jeremiah Wright debacle. He could have denounced bigotry, hatred and racism. Obama would have served his own interests by denouncing the murderous Weatherman he has associated with in several respects. He could also have denounced the financial man he calls friend after his unsavory activities became public.
Nevertheless, Obama missed great opportunities to try his “Sister Souljah” act on the characters described above. Say what you will, the memory of the activities of those pals are deeply imbedded in the political process. The media is not, of course, carrying those stories anymore, but being the astute politician that you are, I am confident that you, Mr. Davis, know that in homes, courthouses and other meeting places individual and groups of individual voters are still discussing them. Obama has lost many votes because of this and those numbers continue to grow.
Keep that terrific smile, Mr. Davis. You are going to need it in the days ahead as Obama tries opportunistic best to find some kind of core within himself that can be believed. Good luck!

It appears that Obama, now more than ever, almost has to rely on these swing voters to replace “hard” Democrats. And maybe this is being simplistic or naive, but I thought by not including retroactive immunity, that it was sort of a “deterent” for any future telecom to handing over consumer information regardless of what the administration tells them.

Big deal. Obama is moving to the center in order to get elected. After he’s sworn in, Pelosi and Reid will pass every conceivable piece of collectivist and even socialist garbage legislation (including a repeal of FISA) and Obama will promptly sign it. Fortunately, it won’t take long for most Americans to discover they elected the worst President in history, and the 2010 mid-terms will put enough conservatives in office to stop Obama’s every move. Two years of Obama’s rising gas prices, energy shortages, higher taxes, higher unemployment, rising food prices, disastrous stock prices, millions more on welfare, and maybe a few terrorist attacks on U.S. soil, and Obama will be a laughed-at lame-duck who will make people long for Jimmy Carter. Americans will learn their lesson the hard way, but they’ll learn their lesson.
And, for the record, it took no “courage” for Bill Clinton to “stand up to” Sister Souljah. He could have spit in her face and blacks still wouldn’t have voted for George Bush. (That’s one of the advantages of being a Democrat, you can take the black vote for granted.)
The real question to me is whether or not Don Imus will invite Rev. Jackson to appear on his show and give him an opportunity to explain his statement which may or may not have been taken out of context.

Obama is not supporting the same FISA bill that he is now supporting; it has been revised. All of Obama’s core principles are still the same. I’ve seen women waiting in line outside of the ladies restroom at a Chicago Cubs baseball game, (after consuming four beers), change stances fewer times than the Obama campaign has in the last two weeks.

Obama is ‘all over the place’ saying anything to anybody, just to win votes. The man is a junior sentator with little more than 143 actual working days. He is so inexperienced I can’t believe he is even considered as a presidental nominee. He has no substance, no stance on anything, so he says whatever the prevailing political winds dictate that day. I feel sorry for those Americans that have been suckered by this guy. I feel extremely sorry for those American Blacks that he has duped by playing the race card. America may be ready for its first black president, but don’t be so fast to grab the first one pushed upon you. We need a man with experience, qualifications, integrity, a love for America, and some intestinal fortitude (guts). Sorry, but Obama is not this man.
To put forward some imperical purpose in Obama’s latest moves on FISA, Iraq, drilling, etc etc is ludicrous. Obama’s is pnadering pure and simple - he pnadered all through teh primaries and now he continues gong into the general elec. So, one year into the game and we really do not know anything about Obama. He has no track record, less than 150 actually on the job in the Senate - shamefull, he has been all over the board on many issues but has participated in remarkably little actual legislation. What we do know is that you cannot trust what he says no matter how sincere he sounds at the time of delivery.
Trying to continue to justify this guy is simply wearing thin - he has little substance and what substance is there is all about Obama.

I find the dichotomy interesting. Libs are excited by the prospect that the evil government my listen in on a phone conversation or tap you e-mail (considered within the governments pervue when conducted on foreign nationals for intelligence purposes). Even when the program has proven extremely useful in stopping terrorists. “Not proven since you can’t trust the Bush Adminsitration… the evil empire”
But they are willing to give the government access to you medical records in a nationalized healthcare system. They want more of my money to redistribute to peolpe they deem as needy, and sic the IRS on me to comb through my records to see if I paid my fair share.
I think the adminstration should be allowed to conduct security, with congressional oversight (keep the trail lawyers out, phone company lawsuits… yikes). But the might mean congress would have to work and take responsibility…. hmmm.
The President will likely take the blame for the next terror attack, though congress ties our hands.

Well put, Bob (July 10 8:31am). The idea of socialized medicine is much more terrifying to me than someone hearing my phone conversations or reading my email. I don’t believe in the Robin Hood way of life, which is clearly the goal of the democratic nominee and many of his supporters. When you run out of rich people to rob, the definition of rich changes, and people like me, who work 40 plus hours per week to support ourselves and our children, suddenly become the “rich.” As a divorced mother of two, I have never looked for a handout from the government (translation: I don’t expect my neighbors, friends, or strangers to pay my way)and I could not support a candidate who has so little respect for people that he assumes we all want to be the recipients of Robin Hood’s spoils. I aspire to be one of those people with plenty of money to spare (much like the Obamas), and I don’t understand the feeling of some people that another person’s financial success is somehow to blame for their own lack of success. I’ve gotten way off the original subject here, but I think it all goes together in the sense that we as voters have a decision to make in November. While neither choice, in my opinion, is ideal (to say the least) I find it frightening to think that someone who stoops to class warfare and racism to get votes could actually become the next president of the United States.

Obama needs to worry more about having “Jessie Jackson Moments” than “Sister Soljiah Moments”. Obama needs to go to Dallas and teach some of his Democrat County Commissioners some science leasons. When you have elected officials attempting to govern a city who have never heard of black holes in space and interpret an analogy to them as a racist comment you have a sad situation. When people can’t use the terms “angle food cake” and “devil’s food cake” or describe someone as a “black sheep”, which simply means “different”, ie. “I come from a family of educators, however, my youngest son went into bussiness so we considere him to be the black sheep of the family” without having them interpreted as racists comments you have a sad situation. I cannot imagine having to go through four years of Obama having to listen to this type ignorance being thrown up every time someone makes an innocent comment. These type ignorant people will turn on Obama the second he doesn’t cater to their ignorance and every imagined grievance the have harbored during their lives will be on public display. If Obama doesn’t support them he will have many more “Jessie Jackson Moments” than “Sister Soljaih Moments”.
I love reading comments from people who claim that Obama supposedly has no idea what he is doing. These are probably the same people who voted for Bush over McCain during the republican primary.
I don’t know what to think of Obama. The only thing I know about him is that he is really good at reciting prepared speeches. That doesn’t necessarily mean he wouldn’t be a good leader but how can you know since he has little experience. And I know people keep saying things about how McCain08 is just a third term Bush, but I would argue Obama is more similar to Bush if you look at experience and expertise. McCain actually has lots of experience, but all that may mean is he has more time to become corrupt which is what all politicians are.
I think this would all be settled if Obama and McCain would actually debate. I wish they could just individually bring up questions to each other and see who better answers them.
Because as of now when people say “I like Obama” what they are saying is I am a liberal and I like Obama’s speech writers, who are very good by the way. I wonder how much of Obama’s book was written by a ghostwriter.
Anyways let them debate and both be asked the very hard questions which don’t have prepared answers. Then maybe we will get a better feel for the candidates as individuals and who they are, rather than who their campaigns and speech writers are.

Politics as usual, is what I see, say one thing, do another. Lets ask the hard quesions here. Why is he suddenly moving to the middle? Is it heart felt change or just a means to win votes in Nov.? Or is it part of his sudden change in view on Iraq? Or, is that just vote getting too? Here is the hardest question of all, can we trust him? People in this country need to start demanding substance in thier elected officials, we need resume’s before election, Job references, and even polygraghs to prove thier honesty. Habitually they speak out of both sides of their faces. My honest opinion at this point is that we the people need to head to washington with pitchforks and take back our government from foriegn lobbiest and governments. Create a constitutional amendment demanding term limits in all branches of government as well as prvent politicians moving from one branch to the next. I can’t believed that we are going to elect the next president of the US from the same pool of crooks, and ill behaved congress even the young senator as Obama have learn how to profit in less that one term (or you thing that you can earn millions with a just salary of a senator!).
Well I guess we have the government we deserved, the congress we elected in the last two years have done nothing other than blame the republicans and the White House on everything and not doing nothing and the candidates are learning to do the same thing, and Obama has become a master of that. How disappionted!
I am a 15 year old and even at my age i want someone who will be experienced and know what they are doing!!Obama has NO clue and i want to have a bright future ahead of me, NOT someone who is going to change everything the american people EVER stood up for!He talks about pulling our troops out..NOT such a good idea if you ask me?That will only show weakness. After all the fighting in our history and all the lives sacrificed I dont think they would be very impressed. Our country is STRONG. But Obama is WEAK! He wants to talk to other countries one on one, WHY AND WHAT is stopping him NOW from doing just that???He is already senator? As far as the gun law he is wanting to enforce; that is our right as americans to arm and protect ourselves..What right is his to take that away from us???WHO does he think he is??After watching Fox News I have seen many young people are leaning towards the vote for Obama. He has false hopes and has lied too many times about his preacher, his friends, and has still not came up with his birth certificate!! I think before anyone decides who they are voting for they need to KNOW the facts. This is OUR future and I want ONE!!!!

Are you saying that Obama and other liberals have found a way to support the tsp because the top secrets that come from the top levels will now be paraded into congress on what they call committees, for safety by way of congressional oversight?
So to keep the DOJ in check the liberals want to make the top secrets accessible to congress persons, their staffers, the staffers friends, the wait staff, parking lot attendants, janitors, the Kremlin, and other people the liberals believe are trustworthy because they show hatred towards the Bush Administration?
Are you saying that Obama now supports the new and improved TSP because in order to get the approval for wiretaps more people get to see what the secrets are, who is involved, etc?
But as it is now, the liberals are FURIOUS with the Bush Administration because of the “secrecy” and not leaking out the top secrets of whats going on, making the NY Times, CBS and other anti American friendly groups have to work harder to find out those secrets?
So the new TSP will provide a layer of security by letting congress persons (and by proxy everyone else) see the top secrets so they can second guess the DOJ? This doesnt make sense, and if it doesnt make sense its probably not true. The liberals do not care about honoring the DOJ, they only want the top secrets
It would be another CBS Pentagon Papers scandal times a few billion, we had to publicly air the top secret information to see if it would be bad or not. According to many on the left, top secrets should be public information. The left cannot force the surrender of the USA in the 2 war fronts, so if they can get access to top secrets and leak/sell them to our enemies maybe the enemies would win and THAT would end the war, and then the classical equation works out: whatever is bad for the United States is good for democrats and VV.
